Qui Tam Recoveries Reach $2.2 Billion For 2022

The Department of Justice (DOJ) recently released a press release regarding qui tam settlements in the fiscal year 2022. Qui tam is a law that allows people to sue on behalf of the government to recover funds that have been wrongfully obtained by fraud. The False Claims Act is the most commonly used qui tam law, and it has been a powerful tool for the DOJ in combating fraud against the government.

A Recent Record In Recoveries

The press release from the DOJ announced that settlements and judgments from False Claims Act cases totaled more than $2 billion in fiscal year 2022. This is a significant increase from the previous year, when qui tam settlements and judgments totaled just over $1.2 billion.  For decades the False Claims Act (“FCA”) has proven to be a crucial tool in the fight against companies and individuals who would defraud the government and misuse taxpayer funds.  More than 600 whistleblowers filed claims during 2022; another sign that the DOJ and US Attorneys’ offices around the country are actively and diligently supporting claims, and that fraud continues to be rampant in sectors including defense, contracting, and health care.  The DOJ cited specific settlements in qui tame cases in Medicare and Medicare abuse, drug pricing, unlawful kickbacks, covid relief, and small business set-aside contracts.

Whistleblowers Crucial In The Fight Against Government Fraud

The increase in qui tam awards is a testament to the success of the False Claims Act in curbing fraud and recovering taxpayer money. Qui tam plaintiffs are essential to the success of the False Claims Act, and the FCA ensures that whistleblowers share in the ultimate recovery. Without qui tam plaintiffs, many of the frauds that the DOJ was able to uncover in fiscal year 2022 would have gone undetected. For qui tam plaintiffs, the financial rewards for their brave actions can be very rewarding. Depending on the outcome of the case, a qui tam plaintiff can receive up to 30% of the total recovery. This means that if the DOJ recovered $2 billion in fiscal year 2022, qui tam plaintiffs could have received up to $600 million in awards for this year alone.
